SMS consent and opt-in

Fluxo is an email and SMS marketing platform for online stores. Merchants use Fluxo to send messages to their own customers. This page describes how those customers give consent to receive SMS, what they are told at the moment they give it, and how they stop the messages.
Who the messages come from
Every SMS is sent on behalf of an individual merchant, and every message identifies that merchant by name. A subscriber who opts in to one merchant never receives messages from another. Fluxo does not send marketing of its own to merchants' subscribers, and consent is never purchased, rented, or shared between merchants.
How consent is collected
Subscribers opt in through one of two mechanisms, both on the merchant's own storefront:
- An onsite signup form. The subscriber enters their phone number and affirmatively checks a consent box. The box is never pre-checked, and consent to marketing SMS is never a condition of purchase.
- A marketing-consent checkbox at checkout. The subscriber affirmatively opts in to receive marketing messages from that store while completing an order.
In both cases the opt-in is explicit and separate from the transaction. Fluxo records the consent against that merchant's audience, along with when it was captured.
What the subscriber is told when they opt in
The consent disclosure shown at the point of opt-in states, in substance:
By providing your phone number, you agree to receive recurring automated marketing text messages from this store at the number provided. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help. See ourPrivacy Policy and Terms of Service.
Confirmation message
After opting in, a subscriber receives a confirmation of the form:
Acme Store: You're subscribed to Acme Store alerts. Msg frequency varies. Msg & data rates may apply. Reply HELP for help, STOP to unsubscribe.

A transactional message:

How to stop receiving messages
Reply STOP to any message to unsubscribe immediately. The opt-out is honored automatically and permanently for that merchant, and no further marketing messages are sent to that number. Reply HELP for help, which returns support contact details for the merchant. Message and data rates may apply, and message frequency varies by merchant.
Data and privacy
Phone numbers and consent records belong to the merchant who collected them and are processed by Fluxo on that merchant's behalf. We do not sell subscriber data.
